ORDINANCE NO. 10519 AN ORDINANCE TO AMEND ORDINANCE NO. 6958, AS AMENDED, KNOWN AS THE ZONING ORDINANCE, SO AS TO REZONE A TRACT OF LAND LOCATED AT 1205 HELENA DRIVE, BEING ON THE NORTHWEST LINE OF HELENA DRIVE NORTHEAST OF HIGHWAY 153, FROM R-2 RESIDENTIAL ZONE TO C-2 CONVENIENCE COMMERCIAL ZONE, SUBJECT TO CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That Ordinance No. 6958, as amended, known as the Zoning Ordinance, be and the same is hereby amended so as to rezone: A tract of land located at 1205 Helena Drive, being on the northwest line of Helena Drive northeast of Highway 153. Part of lot 28, Revised Plat of Gadd Road Subdivision, as shown by plat of record in plat book 22, page 72, ROHC; being part of the property described in deed book 2388, page 505, ROHC. Said part of lot begins on the northwest line of Helena Drive some 318.28 feet northeast, then southeast, then northeast of the intersection of the northwest line of Helena Drive with the northeast line of Highway 153, said point being the southwest corner of said lot 28, thence northwest 159 feet with the southwest line of lot 28 to the northwest corner thereof, thence northeast 50 feet with the northwest line of lot 28 to the southwest corner of lot 1, said subdivision, thence southeast some 155 feet crossing said lot 28 to the southwest corner thereof, the point of beginning. Tax Map No. 100P-A-39 (part). from R-2 Residential Zone to C-2 Convenience Commercial Zone. SECTION 2. BE IT FURTHER ORDAINED, That this rezoning shall be subject to the following conditions: 0C 1. No access from Helena Drive; 2. The owner of the tract shall install and maintain natural screening as set forth in Article V, Section 1024(7)(a) and (b) of the Zoning Ordinances provided that the 15 foot buffer width requirement is deleted therefrom; and 3. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage, as provided by law.
